May I apply for permanent residence while on an h-1b visa?

Once obtaining an H-1B visa, the temporary work may pursue Labor Certification, a lengthy process whereby the U.S. employer sponsors the foreign worker to obtain status that may eventually lead to Legal Permanent Residence status. Labor Certification, just like H-1B status, is discretionary with the INS. That is, the right to apply for Labor Certification does not necessarily mean that it will be granted by the INS.
